By creating an account, browsing our website, or linking third-party communication channels to SmartApply, you confirm that you are at least 16 years of age, have the legal capacity to enter into this agreement, and agree to adhere to all terms specified herein. If you do not agree to these Terms, you must immediately discontinue using our services.

SmartApply provides a unified digital toolkit for students, researchers, and prospective scholars applying to international universities (e.g., in Canada, USA, UK, Germany, Italy, Netherlands, and Sweden):

• Scholarship & University Database: Curated catalogs of active undergraduate and graduate scholarships, eligibility rules, and official program deadlines.
• Document Studio & SOP Analyzer: Tools and proven templates for structuring statements of purpose, cover letters, and research proposals.
• Academic Supervisor Directory: Faculty listings, research interests, and public university contact details.
• Application Tracker: Real-time checklist and progress dashboard for managing multiple university submissions.
• 24/7 AI Admissions Assistant: Multi-turn LLM agent accessible on web and Telegram for scholarship discovery, cold email drafting, and query resolution.

You are responsible for maintaining the confidentiality of your login credentials, password, and Telegram 6-digit pairing codes. You agree to notify us immediately at security@marcalyx.com of any unauthorized access to your account. SmartApply is not liable for any losses arising from unauthorized account usage resulting from your failure to protect your credentials.

SmartApply is committed to ethical academic practices and applicant authenticity. You agree that you will not:

• Falsify Academic Information: Use our tools to forge, fabricate, or falsify academic credentials, grades, test scores, research publications, or recommendation letters.
• Violate University Honor Codes: Submit purely automated, unverified content where a university explicitly prohibits AI-assisted drafting without disclosure.
• Spam Faculty or Supervisors: Send automated, bulk, deceptive, or abusive mass emails to university professors or admissions departments.
• Scrape or Abuse Platform Services: Attempt to reverse engineer, scrape, overload, or bypass rate limits on our backend APIs, databases, or AI models.

Your Content Belongs to You: You retain 100% intellectual property ownership, copyright, and title to all personal essays, statements of purpose, research proposals, and documents you write or generate in SmartApply. We claim no ownership over your submissions.

Platform Intellectual Property: SmartApply, its logos, trademarks, database schema, algorithms, UI components, and curated scholarship content are the exclusive property of Marcalyx Tech and protected under international copyright and trademark laws.

SmartApply provides AI-powered writing assistance, suggestions, and critique as brainstorming and structuring tools. You acknowledge and agree that:

SmartApply offers free access tiers as well as premium subscription plans with advanced AI coaching and unlimited supervisor contact lookup.

• Billing: Premium features are billed on a recurring monthly or annual basis as displayed at checkout.
• Cancellation: You can cancel your subscription at any time via your Account Settings. You will retain access until the end of your paid billing period.
• Refunds: Except where required by applicable consumer law, subscription fees are non-refundable once the billing period has commenced.

To the maximum extent permitted by law, SmartApply, Marcalyx Tech, its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, missed university deadlines, rejected applications, or visa denials resulting from the use or inability to use the Platform. The Platform is provided on an "AS IS" and "AS AVAILABLE" basis.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive activities. These Terms shall be governed by and construed in accordance with the applicable laws, without regard to its conflict of law provisions.

We may update these Terms periodically. Continued use of SmartApply following published updates constitutes acceptance of the revised Terms.
